Alaska prosecutes “drunk drivers" under two theories: violating Alaska’s “per se” law, meaning, driving with a blood or breath alcohol content at or above the legal limit or driving while impaired. Driving while “drunk” or impaired can be determined by chemical test results, driving patterns, and field sobriety tests.
